個人資料聲明

此聲明確保本公司有關收集、使用、保障及查閱個人資料的政策及慣例皆根據《個人資料（私隱）條例》－第486章（「條例」）的規定所辦理。

1. 閣下有權拒絕提供閣下之個人資料，惟本公司所要求之個人資料乃為完成閣下所要求之服務之必需資料。
2. 根據條例，閣下有權要求查閱及更正我們所持有閣下的個人資料。
3. 本公司會將閣下之個人資料保密。閣下的個人資料只會於下述用途，或獲得閣下同意或按法例要求之情況下被披露及使用。
4. 本公司可利用或透露閣下之個人資料作下列用途：(a) 為閣下提供本公司的服務及本公司行使其向閣下提供服務有關之權利；(b) 信貸查核；(c) 債務處理；(d) 市場調查；(e) 防止或偵查罪案；(f) 按法例或政府當局要求披露有關資料；(g) 提供緊急服務；及(h) 其他獲雙方同意的用途。
   此外，我們可於獲閣下同意下，使用閣下之個人資料，直接促銷與閣下選用本公司之產品及/或服務相關之產品或優惠。
5. 本公司可就上文第4點所列的有關用途，把所收集的客戶個人資料提供予本公司之供應商、承包商、代理商及其他網絡供應商。在此情況下，上述的第三方皆不可利用客戶個人資料作指定使用範圍以外之用途。
6. 如閣下對本個人資料聲明需作出查詢或需查詢或更正閣下的個人資料，閣下均應以書面形式提出有關請求並寄到以下地址：

Terms & Conditions

1. Introduction

The Site is operated by Asia Pacific Industrial Safety Equipment (“APISE” or “we”). It provides an online interactive transaction platform to offer our products. In accessing the Site and conducting any transactions therein (“you” or the “End User”) are deemed to have accepted the following conditions and any guidelines or policies as published by APISE concerning the use of the Site (“Terms of Use”).

 

2. Using the Site
   
   2.1 In using the Site, you shall not:
1. violate any laws, third party rights, or APISE’s policies concerning the use of the Site as published by APISE on the Site;
2. use the Site or any products offered by
   APISE if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from the Site;
3. default in payment for any products purchased  by  you  offered  on  the  Site,  unless we have materially changed their description after your purchase, or a clear typographical error is made;
4. authenticate the Merchants’ identity;
5. circumvent or manipulate our fee structure, the billing process, or fees owed to APISE;
6. take any action that may undermine the  feedback or ratings  systems  (such  as   displaying,  importing  or
   exporting feedback information off the Site or for using it for purposes unrelated to APISE);
7. transfer your account (including feedback) or your User
   ID of the Site to another person without our consent; or
8. distribute viruses or any other technologies that may harm the Site.

 

2.2 You acknowledge and agree that access to the Site does not give you the right to use any of the trademarks, trade names or logos (collectively the "Marks") of APISE or its affiliates or Merchants. You shall not use any of the Marks in any advertising, publicity or any manner without the prior written consent of APISE.

2.3 In using the Site, you are responsible for maintaining the confidentiality of your account details and any password and for restricting access to your computer, and you agree to accept responsibility for any activities that occur under your account or password. APISE reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

2.4 You shall indemnify and hold harmless the Site of APISE, its officers and agents (the "Indemnified), against any claims, losses or damages which the Indemnified may suffer or incur as a result of any acts or omissions committed by you; any breach by you of the Terms of Use or any unauthorized activity by you on the Site.

 

3. Your Information

3.1 In order to proceed and complete your online shopping transaction via the Site, you will be required to provide your personal data including personal identification number, credit   card  details   (“Personal   Data”).   Your   intended transaction may not be processed or completed if you fail to provide true and accurate information required.  Please refer to   APISE 's  Personal Data Statement as published on www.web-123.com.

3.2 You hereby agree that, APISE (including its contractors, agents or third parties as authorized  by APISE) may use and/or  disclose  your  Personal  Data  to  any  third  party (including the Merchants)  for the purpose of processing and completing your  online shopping transaction via the Site;  conducting credit checks; debt collection; market research; informing you (including by direct marketing) of products  or  offers  of  APISE  related  to  online  shopping transaction; prevention or detection of crime; disclosure as required by law or  a government authority or any other purposes  as   may  be  agreed  between  us.  In these circumstances, these third parties can make no use of your Personal Data other than for the purpose for which it was provided.

3.3 You may request for a record of the Personal Data kept by APISE and request APISE to correct such Personal Data. Such requests shall be made in writing and any requests by you for changes to your Personal Data shall be supported by relevant documentation. 

 

4. Our Rights

We aim to ensure that all products for online shopping on the Site do not infringe upon any intellectual property rights of third parties. We may limit, suspend, or terminate your user’s accounts, prohibit access to the Site, delay or remove hosted content, and take steps to keep users off the Site if the users are creating problems or possible legal liabilities, infringing the intellectual property rights of  third  parties,  or  acting  inconsistently  with  the intended use of the  Site. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time.

5. Charges and Payments

All charges for products offered by the Merchants on the Site will be as specified on the Site (the “Charges”). APISE reserve the right to amend any Charges and payment   terms.   All   Charges   are   exclusive   of   any applicable taxes, withholdings of  any  kind,  surcharges, duties or  other similar charges assessed or imposed by any   competent  governmental  authority  ("Taxes"); or any transaction fees, exchange rate charges or other similar charges assessed or imposed by banks or financial institutions (“Bank Charges”).   You shall pay and be solely responsible for any and all Taxes and Bank Charges. You shall not in any event deduct any Taxes or Bank Charges from the Charges payable to APISE.  You shall pay APISE the full amount of the Charges as specified without deduction or set-off.  Any late payment shall be deemed a material breach of  the Terms of Use which entitles APISE to take such action against you as it considers fit.

Please refer to the Buyers’ Protection Policy on the Site for details regarding purchase of products via the Site. For the avoidance of doubt, you shall be solely responsible for the delivery cost of any return of products to the Merchants for whatever reasons.

 

6. Limitation of Liability

6.1 All information, content, materials, products available on the Site or otherwise made available to you are provided by APISE's on an "AS IS" and  "AS  AVAILABLE BASIS".  APISE does not make any   representations or warranties of any kind, express or implied as to the operation of the Site or the information, content, materials, products included on or otherwise available to you through the Site. You expressly agree that your use of the Site is at your own risk. APISE disclaims any warranties; express or implied, including implied warranties of merchantability and fitness for a particular purpose. APISE does not warrant that the Site, information, content, materials, products included or otherwise made available to you through the Site; its servers; or emails sent from APISE's website  are  free  of viruses or other harmful components.

6.2 The liability of APISE whether arising from a  breach of contract or negligence on the part of APISE or the employees or agents or contractors or suppliers of APISE shall be limited to  the  supply  or  re-supply   of  the  products  or Charges paid by you.

6.3 Notwithstanding anything contained in the Terms of Use, under no circumstances shall APISE, its employees, agents or contractors or suppliers be liable in any way whatsoever to you  or  any  other   person  for  any  special,  indirect  or consequential  loss  or  damage,  loss  of  profit,  business, revenue, goodwill, use of data or anticipated savings. APISE shall not be liable to you or any person claiming through you for any defaults caused by an event beyond the reasonable control of APISE. 

7. General Provisions

7.1 The Terms of Use represents the entire understanding between APISE and you relating to the use of the Site or any transactions conducted  via the Site and there is no promises, terms,  conditions or obligation, oral or written, expressed or implied, other than those contained herein.

7.2 Each of the provisions  in  the  Terms  of   Use  is severable and distinct from the others and, if one or more of  such  provisions  is  or   becomes  illegal,  invalid  or unenforceable,  the   remaining  provisions  shall  not  be affected in any way.

7.3 The Terms of Use and any transactions contemplated through the Site shall be governed by the laws of Hong Kong SAR and subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

7.4 The Terms of Use may be amended from time to time by APISE and such amendments shall become effective on the date when published by APISE.

7.5 The Terms of Use may be translated into Chinese. If there is any inconsistency or conflict between the English version and the Chinese version, the English version shall prevail to the extent of such inconsistency or conflict.

7.6 No delay, neglect or forbearance on the part of APISE in enforcing against you any term or condition of the Terms of Use shall either be or be deemed to be a waiver or in any way prejudice any right of APISE under the Terms of Use.
